The Question:

The above picture shows a railroad crossing where a train has just passed. A pedestrian is waiting for the railroad gates to raise. There are no sidewalks and very little shoulder. To avoid traffic the person walks off the shoulder and around the signal lights. Is this permissible?

The Answer: NO

It is ILLEGAL to walk around a railroad signal crossing gate while it is down. It is also considered trespassing. Railroad tracks are private property.

This answer is based onĀ Idaho state codeĀ 49-710 (2).
