The Question:
The above picture shows a bicyclist exiting a driveway to enter the street. The bicyclist notices a pedestrian walking on the sidewalk. The bicyclist stops and waits for the person walking to pass safely. If a sidewalk is clear of all cross traffic (people walking, biking, etc) is a bicyclist still required to stop before driving onto it?
The Answer: Yes
A bicycle under Idaho law is considered a vehicle when operated on any highway. Therefore, any motorist or bicyclist exiting a public or private driveway in a residential or business district, shall stop his or her vehicle “…prior to driving onto a sidewalk.”
This answer is based on Idaho state code 49-651.
